Simply Pages is a website builder that allows users to create and design web pages. The Service is provided on an "as is" and "as available" basis without any warranties of any kind.

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You may delete your account at any time. Upon account deletion, your personal information will be handled as described in our Privacy Policy.

IMPORTANT: While we store your login details and payment information in our cloud servers, the website builder data you create is stored solely in your browser's local storage. If you clear your browser data, use a different browser, or access the Service from a different device, your website builder data may not be accessible.

We do not take responsibility for any loss of data that occurs due to:

• Clearing your browser cache or local storage
• Browser or device malfunctions
• Using different browsers or devices
• Any other circumstances that result in the deletion or corruption of locally stored data

You are strongly advised to regularly export and back up your website data to prevent loss.

Simply Pages offers free website building capabilities. Exporting your website requires payment as per our current pricing structure, which is subject to change.

All payments are non-refundable except in cases where there is a demonstrable system failure or error on our part that prevents the delivery of the service paid for.

We reserve the right to introduce subscription services in the future. Any such changes will be communicated to users, and these Terms will be updated accordingly.

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms.

Prohibited uses include, but are not limited to:

• Creating websites that promote illegal activities
• Creating websites that contain malware, viruses, or harmful code
• Creating websites that infringe on intellectual property rights
• Creating websites that contain hate speech, harassment, or threatening content
• Creating websites that distribute spam or engage in phishing
• Any other abusive or illegal purposes

We reserve the right to terminate your access to the Service immediately, without prior notice or liability, if you breach the Terms or if we determine, in our sole discretion, that your use of the Service is inappropriate or harmful.

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Edgendary AI Labs Pvt. Ltd. and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries.

In no event shall Edgendary AI Labs Pvt. Ltd., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Loss of website builder data stored locally in your browser

Our liability is limited to the maximum extent permitted by applicable law.

You agree to defend, indemnify, and hold harmless Edgendary AI Labs Pvt. Ltd. and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your content caused damage to a third party

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

These Terms constitute the entire agreement between you and Edgendary AI Labs Pvt. Ltd. regarding our Service and supersede all prior agreements and understandings, whether written or oral, regarding the Service.
